Opći uvjeti poslovanja

Ovi uvjeti kupovine sastavljeni su u skladu s odredbama Zakona o elektroničkoj trgovini (NN br. 173/03, 67/08, 36/09, 130/11 i 30/14), Zakona o zaštiti potrošača (NN br. 41/144, 110/15) i Zakona o obveznim odnosima (NN br. 35/05, 41/08, 125/11, 78/145), te predstavljaju prethodnu obavijest u smislu članka 57. Zakona o zaštiti potrošača (NN br. 41/14, 110/15).

Kupac

Kupac je svaka fizička osoba koja sklapa pravni posao ili djeluje na tržištu izvan svoje trgovačke, poslovne, obrtničke ili profesionalne djelatnosti, te koja prihvaća opće uvjete poslovanja tvrtke Black hill d.o.o. (u daljnjem tekstu: Opći uvjeti).

Prihvaćanje Općih uvjeta kupac potvrđuje narudžbom proizvoda putem elektroničke (internet) trgovine. Korištenje usluga i sadržaja internet stranice https://commodoresgin.com odobrava se isključivo punoljetnim i poslovno sposobnim osobama. Roditelji i/ili skrbnici dužni su o tome voditi računa, u protivnom preuzimaju sva prava i obveze nastale takvim korištenjem, a Black hill d.o.o. ne odgovara za eventualne posljedice takvog korištenja obzirom da je prije ulaza na internet stranicu https://commodoresgin.com jasno i vidno istaknuto pitanje “Imate li dovoljno godina da biste legalno konzumirali alkohol u vašoj zemlji?“.

Osobama mlađim od 18 godina Zakonom je zabranjena prodaja alkoholnih pića i drugih pića koja sadrže alkohol.

Svaki kupac dužan je na upit dostavljača predočiti dokument kojim dokazuje svoju punoljetnost.

Opće odredbe

Ovi Opći uvjeti dostupni su kupcima u svako doba i iste je moguće spremiti, ponovno koristiti i reproducirati. Općim uvjetima uređuju se odnosi između kupca i prodavatelja vezano uz uvjete i način naručivanja proizvoda, cijene proizvoda, uvjete i načine plaćanja, odgovornost za nedostatke, prava kupca na pisani prigovor na proizvode prodavatelja, pravo na raskid ugovora, uvjete dostave proizvoda, zaštite osobnih i drugih podataka i ostala pitanja važna za sklapanje ugovora o kupoprodaji putem elektroničke trgovine.

Opći uvjeti poslovanja internet trgovine čine sastavni dio svakog kupoprodajnog ugovora zaključenog između prodavatelja i kupca ovim putem. Kupci su dužni dati točne, važeće i potpune osobne podatke prilikom ispunjavanja registracijskog obrasca.

Suprotno postupanje kupca ovlašćuje prodavatelja da uskrati prodaju proizvoda.

Prodavatelj je ovlašten, u skladu sa svojom poslovnom politikom, bez potrebe prethodne obavijesti, izmijeniti sadržaj Općih uvjeta, prodajni asortiman proizvoda, maloprodajne cijene i druge podatke vezane uz ovu internet stranicu. Izmijenjeni sadržaj Općih uvjeta stupa na snagu nakon objave na ovim internet stranicama.

Cijene

Cijena izražene u našoj online trgovini su maloprodajne, sa uključenim PDV-om i naknadom od 0,10 eura (povratna naknada) kada je ista primjenjiva..

Narudžba i postupak kupnje

Postupak kupnje započinje narudžbom proizvoda putem elektronskog obrasca narudžbe. Kupnja se obavlja odabiranjem proizvoda u željenoj količini, spremanjem u košaricu u kojoj se nalazi pregled odabranih proizvoda s pojedinačnom i ukupnom cijenom. U košarici kupac može povećavati broj istog, već kupljenog proizvoda, brisati ili mijenjati odabrane proizvode.

Nakon odabira svih željenih proizvoda i nakon ispunjavanja svih traženih rubrika nužnih za komunikaciju, prodaju i dostavu, klikom na link NARUČITE kupac potvrđuje narudžbu.

Proizvodi se smatraju naručenim i ugovor sklopljen kada kupac plati ili potvrdi prihvat navedene ponude.

Pojedini proizvodi mogu biti nedostupni ili rasprodani. Ako nismo u mogućnosti isporučiti neki od naručenih proizvoda ili sve naručene proizvode, kontaktirati ćemo Vas ili e-mailom, te Vas obavijestiti o mogućem naknadnom terminu isporuke, dok će svi ostali naručeni proizvodi biti isporučeni. Po primitku takve obavijesti kupac je dužan e-poštom obavijestiti prodavatelja prihvaća li novi rok isporuke za neisporučeni proizvod ili u tom dijelu odustaje od kupnje.

Dostava proizvoda

Proizvode iz naše online trgovine dostavljamo na području Republike Hrvatske i određene zemlje EU.

Cijena dostave izražena je u odnosu na težinu paketa i zonu dostave a ne u odnosu na broj proizvoda u Vašoj košarici.

Materijalni nedostaci / šteta pri transportu robe

Proizvodi će biti zapakirani tako da se uobičajenom manipulacijom u transportu ne mogu oštetiti.

U tom slučaju potrebno je obavijestiti prodavatelja kako bi se u što kraćem roku organizirala nova isporuka ili dogovorile daljnje radnje.

Jednostrani raskid ugovora

Korisnik može jednostrano raskinuti Ugovor u roku od 14 (četrnaest) dana bez navođenja razloga. Korisnik nema pravo na jednostrani raskid Ugovora:

ako mu je usluga u potpunosti ispunjena, a ispunjenje je započelo uz njegov izričit prethodni pristanak te uz njegovu potvrdu da je upoznat s činjenicom da će izgubiti pravo na jednostrani raskid Ugovora ako mu usluga bude potpuno ispunjena,

ako je predmet Ugovora zapečaćena roba koja zbog zdravstvenih ili higijenskih razloga nije pogodna za vraćanje, a bila je otpečaćena nakon dostave,

ako je predmet Ugovora roba koja je zbog svoje prirode nakon dostave nerazdvojivo pomiješana s drugim stvarima,

ako je predmet ugovora proizvod ili usluga čija je cijena ovisna o promjenama na financijskom tržištu koje su izvan utjecaja Prodavatelja, a koje se mogu pojaviti za vrijeme trajanja prava Kupca na jednostrani raskid ugovora,

ako je predmet ugovora proizvod koja je izrađen po specifikaciji Kupca ili koji je jasno prilagođen Kupcu,

ako je predmet ugovora isporuka alkoholnih pića čija je cijena ugovorena u trenutku sklapanja ugovora, a dostava može uslijediti tek nakon 30 dana, ako je cijena ovisna o promjenama na tržištu koje su izvan utjecaja Prodavatelja.

Ako je prilikom utvrđivanja neispravnosti proizvoda konzumirano više od pola proizvoda.

Da bi korisnik mogao ostvariti pravo na jednostrani raskid Ugovora, mora obavijestiti tvrtku Black hill d.o.o. o svojoj odluci o jednostranom raskidu Ugovora prije isteka roka i to nedvosmislenom izjavom poslanom poštom (Black hill d.o.o., Antuna Branka Šimića 4, 21 000 Split) ili elektroničkom poštom na info@black-hill.hr, u kojoj ćete navesti svoje ime i prezime, adresu, broj telefona, telefaksa ili adresu elektroničke pošte, a može koristiti i navedeni pisani obrazac za jednostrani raskid Ugovora.

Također, Obrazac za jednostrani raskid Ugovora možete pronaći na slijedećoj poveznici OVDJE, korisnik može elektronički ispuniti i poslati u kojem će mu slučaju tvrtka Black hill d.o.o. bez odgađanja dostaviti potvrdu primitka obavijesti o jednostranom raskidu Ugovora elektroničkom poštom.

Rok za jednostrani raskid Ugovora iznosi 14 (četrnaest) dana od dana kada je korisniku ili trećoj osobi koju je korisnik odredio, a koja nije prijevoznik, roba koja je predmet Ugovora predana u posjed, odnosno u slučaju usluge, od sklapanja Ugovora.

Ako korisnik jednostrano raskine Ugovor, izvršit će mu se povrat sredstava koji je od njega primljen, uključujući i troškove isporuke, bez odgađanja, a najkasnije u roku od 14 (četrnaest) dana od dana kada tvrtka Black hill d.o.o., odnosno info@black-hill.hr zaprimi korisnikovu odluku o jednostranom raskidu Ugovora, osim ukoliko je korisnik odabrao drugu vrstu isporuke, a koja nije najjeftinija standardna isporuka koja je ponuđena. Povrat sredstava bit će izvršen na isti način na koji je korisnik izvršio uplatu. U slučaju da korisnik pristaje na drugi način povrata plaćenog iznosa, ne snosi nikakve troškove u odnosu na povrat. Povrat novca Black hill d.o.o. može izvršiti tek nakon što nam je roba vraćena.

Korisnik je dužan robu predati ili je poslati na adresu Black hill d.o.o., Antuna Branka Šimića 4, 21000 Split , bez nepotrebnog odgađanja, a u svakom slučaju najkasnije u roku od 14 (četrnaest) dana od dana kada je Black hill d.o.o., odnosno info@black-hill.hr, uputio svoju odluku o jednostranom raskidu Ugovora. Izravne troškove povrata robe korisnik snosi sam.

Korisnik je sukladno članku 77. stavak 5. Zakona o zaštiti potrošača odgovoran za svako umanjenje vrijednosti robe koje je rezultat rukovanja robom, osim onog koje je bilo potrebno za utvrđivanje prirode, obilježja i funkcionalnosti robe. U slučaju oštećenja originalne ambalaže iznos povrata bit će umanjen za postotak sukladan vrijednosti robe. U tom slučaju korisnik će biti obaviješten o iznosu za koji će povrat biti umanjen.

Ako je na zahtjev korisnika izvršavanje usluge započelo tijekom roka za jednostrani raskid Ugovora, korisnik je dužan platiti Black hill d.o.o. iznos koji je razmjeran onom što je isporučeno do trenutka kada je korisnik obavijestio Black hill d.o.o. o jednostranom raskidu Ugovora.

Povrat sredstava

Ukoliko se slučajno dogodi da robu koju ste platili iz nekog razloga trenutno nemamo na zalihama, izvršit ćemo povrat sredstava u roku 24 sata. Po potrebi ćemo Vas i kontaktirati da li želite da se ostatak narudžbe šalje.

Moguće su greške u sustavu navođenja cijena. U tom slučaju prodavatelj nije dužan isporučiti navedene proizvode po cijeni proizvoda toliko niskoj da kupac zna ili je morao znati da je riječ o pogrešci, a ne o realnoj cijeni proizvoda.

Slike prikazuju boce sa serijama koje se mogu razlikovati od serije (Batch no.) koja će biti isporučena kupcu. Ne garantiramo isporuku serije sa slike već serije koja je dostupna na našim zalihama.

Razlika serije na slici proizvoda i serije isporučene kupcu nije razlog za povrat isporučenog proizvoda.

Prigovori potrošača

Kupac je dužan prilikom preuzimanja proizvoda provjeriti eventualna oštećenja i odmah ih reklamirati dostavnom radniku koji je robu dostavio, odnosno odbiti preuzeti pošiljku na kojoj su vidljiva vanjska oštećenja. U tom slučaju potrebno je obavijestiti prodavatelja kako bi se u što kraćem roku organizirala nova isporuka ili dogovorile daljnje radnje.

Rješavanje sporova

Eventualne sporove prodavatelj i kupac nastojat će riješiti dogovorom i mirnim putem.Posebnom regulativom Europske unije od 15.02.2016. sporove na području EU vezane uz internetsku kupnju biti će moguće riješiti putem ORS platforme (eng. ODR) kojoj možete pristupiti preko internet stranice:

Platformu mogu koristiti i potrošači i trgovci, a prigovor je moguće podnijeti na bilo kojem od 25 službenih jezika EU.

Promjene Općih uvjeta kupovine

Prodavatelj pridržava pravo izmjene Općih uvjeta, kao i bilo koje izmjene internet stranice, njezine strukture, usluge, bilo kojeg sadržaja bez da o tome prethodno obavijestio Kupca. Izmijenjeni uvjeti stupaju na snagu u trenutku objave na stranici.

Korištenjem Internet trgovine https://commodoresgin.hr nakon objavljenih izmjena podrazumijeva se da kupac prihvaća sve aktualne Opće uvjete kupovine.

Prodavatelj zadržava pravo da uvede promidžbene plakate bilo koje prirode i/ili veze na internet stranicu uz poštivanje važećeg zakonodavstva.

Customer

Buyer is any person who commits to legal transaction or acts on the market outside his trade, business, craft or professional activity and accepts the general terms of business of Black hill d.o.o. (hereinafter: General Terms and Conditions).

The prices shown in our online store are retail, with VAT included and a fee of 0.50 HRK (refundable fee) when applicable.

Orders and Purchase Procedure

Products are deemed to be ordered and a contract concluded when a customer pays or confirms receipt of the offer.

Some products may be unavailable or sold out. If we are unable to deliver any of the products ordered or all the products ordered, we will contact you by e-mail and notify you of any possible later delivery terms and all other ordered products will be delivered. Upon receipt of such notice, the buyer must notify the seller by e-mail of whether the new delivery deadline for the undelivered products is accepted or of the withdrawal from the purchase.

Delivery of the product

We deliver products from our online store to the cities in the Republic of Croatia and certain EU countries.

The shipping cost is expressed in relation to the weight of the package and the shipping area rather than the number of products in your cart.

Material defects / Goods damaged in transport

Our products will be packed in such a way that they can not be damaged by common manipulation in transport.

The buyer is obliged to check for possible damages when picking up the product and immediately advise the delivery worker who delivered the goods and refuse to accept the shipment where there is visible external damage.

In this case, the seller should be notified in order to arrange for a new delivery as soon as possible or to arrange for further action.

Single-sided termination of contract

The User may terminate the Contract within 14 (fourteen) days without giving any reasons. User is not entitled to one-sided termination of the Contract in the following cases:

if his service is fully fulfilled and fulfillment has commenced with his explicit prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Contract if his service is fully fulfilled,

if the subject of the contract is sealed goods which, due to health or hygiene reasons, are not eligible for repayment and were cleared after delivery,

if the subject of the Contract is goods which because of its nature, after delivery, is inseparably mixed with other things,

if the subject of the contract is a product or service whose price is dependent on changes in the financial market that are outside the influence of the Seller and may arise during the term of the Customer’s right to unilateral termination of the contract,

if the subject of the contract is a product made by the Buyer’s specification or clearly conformed to the Customer,

if it is the subject of a contract for the supply of alcoholic beverages whose price is contracted at the time of the conclusion of the contract and delivery may only be effected after 30 days

if the price is dependent on market changes that are outside the influence of the Seller.

If more than half of the products are consumed when defective products are found.

In order for a user to exercise the right to unilaterally terminate the Contract, he / she must notify the company Black hill d.o.o. about its decision to terminate the Contract unilaterally before the expiration of the deadline and by an unambiguous statement sent by post (Black hill d.o.o., Antuna Branka Šimića 4,21000 Split,); or by e-mail at info@black-hill.hr, in which you will enter your name, surname, address, phone number, fax or e-mail address, and may also use the written form for unilateral termination of the contract.

Also, the Single Term Contract Agreement can be found at the following link HERE, the user can electronically fill out and send in which case the company Black hill d.o.o. shall without delay submit a receipt of the notification of the unilateral Termination of the Contract by e-mail.

The period of termination of the Contract is 14 (fourteen) days from the date when the user or third person designated by the user (who is not the carrier) the goods that are the subject of the Contract have been in possession off or in the case of service since the conclusion of the Contract.

The User is obliged to deliver the goods or send them to Black hill d.o.o., Antuna Branka Šimića 4, 21 000 Split, without undue delay, and in any event no later than 14 (fourteen) days after the day Black hill d.o.o. , ie info@black-hill.hr, made its decision for the unilateral termination of the Contract. The direct costs of reimbursement of the goods are borne by the user himself.

In accordance with Article 77, paragraph 5 of the Consumer Protection Act, the User shall be liable for any impairment of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and function of the goods. In case of damage to the original packaging, the amount of the refund will be reduced by the percentage of the equivalent value of the goods. In that case, the user will be informed of the amount for which the refund will be reduced.

Refund

In case that you have paid for the goods that we currently do not have on stock, we will refund the money within 24 hours. If needed, we will contact you if you want the rest of the order to be sent.

Images show bottles with batches that can be different from series (Batch no.) to be delivered to the buyer. We do not guarantee the delivery of batch numbers on images but once that we have available on our stock.

The difference in the product and batch image series supplied to the customer is not a reason for the return of the delivered product.

The Seller reserves the right to modify the General Terms, as well as any changes to the Website, its structure, services, or any content without prior notice to the Buyer. The modified terms will take effect at the time of publication on the page.
